End User License Agreement for the Happiness Evolution app.
Please read this End User License Agreement ("Agreement") carefully before downloading or using the Happiness Evolution application ("App"). By downloading or using the App, you agree to be bound by the terms of this Agreement.
Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on a device that you own or control, solely for your personal, non-commercial purposes.
The App and all content, features, and functionality (including but not limited to the nine concepts, exercises, AI-generated content, and visual design) are owned by Adam Emery / Happiness Evolution and are protected by copyright and other intellectual property laws. This License does not give you any ownership interest in the App.

The App offers a free tier and a Premium subscription.
Free Tier: Available to all users at no cost. Includes access to all nine concepts, core exercises, daily check-ins, streak tracking, emotional patterns, and limited Evo chat (10 messages).
Premium Subscription:
Achievement-Based Premium: Users may redeem 2,000 in-app achievement points for one month of Premium access. This is subject to availability and may be modified or discontinued at any time.
The App uses artificial intelligence (Anthropic's Claude API) to generate personalized responses from Evo. AI-generated content:

Happiness Evolution is a personal growth and self-reflection tool. It is not a medical device, a clinical mental health service, or a therapy application. Nothing in the App or generated by Evo constitutes medical advice, diagnosis, or treatment.
The App allows you to write and store personal reflections and exercise responses ("User Content"). You retain ownership of your User Content. By using the App, you grant us a limited license to store and process your User Content solely to provide the App's services (including generating Evo responses). We do not use your personal reflections for marketing purposes.
Your use of the App is also governed by our Privacy Policy. The Privacy Policy is incorporated into this Agreement by reference.
The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that AI-generated content will be accurate, complete, or suitable for your particular situation.
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the App, including but not limited to emotional distress, loss of data, or reliance on AI-generated content. Our total liability to you for any claim arising out of this Agreement shall not exceed the amount you paid for the App in the twelve months preceding the claim.
We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. Upon termination, your license to use the App ceases immediately. Sections 2, 5, 6, 9, 10, and 13 survive termination.
We may update the App and this Agreement from time to time. Continued use of the App after an update constitutes acceptance of the revised Agreement. We will notify you of material changes via the App or by email.
This Agreement shall be governed by the laws of [Your Jurisdiction], without regard to conflict of law principles.
